5. Open Forum (7:40 p.m.)

The Open Forum is a portion of the Council meeting where a maximum of three persons will be allowed to address the Council on subjects which are not a part of the meeting agenda. Speakers are asked to limit their remarks to two minutes each. Persons wishing to speak must complete a sign-up sheet prior to the start of the meeting. Give the sign-up sheet to any staff person. The Council may take action or reply at the time of the statement or may give direction to staff at the end of the meeting regarding investigation of the concerns expressed.

 

6. Consent Agenda (7:45 p.m.)

All items listed under the consent agenda are considered to be routine by the City Council and will be enacted by one motion and an affirmative vote by roll call of a majority of the members present. There will be no separate discussion of these items unless a Council Member or citizen so requests, in which event, the items will be removed from the consent agenda and considered a separate subject of discussion by the Council.

A.     Approval of Council Minutes - August 22, 2007

B.     Lake Road Utility and Street Improvement Project from Manning Avenue to One-quarter Mile West, including Manning Avenue Turn Lanes, Authorize Acquisition of a Pond Outlot and Temporary Construction Easements, Oehlke Property, Parcel 24, Geo Code 24-028-2111-0006, S.A.P. 192-115-003

Staff recommends Council adopt RESOLUTION NO. 07-197, a resolution authorizing payment of $33,732 to Francis and Marylis Oehlke for the acquisition of pond outlot and temporary construction easements for the Lake Road Utility and Street Improvement Project from Manning Avenue to One-quarter Mile West, including Manning Avenue Turn Lanes, Geo Code 24-028-2111-0006, S.A.P. 192-115-003.

C.     MCES Trunk Sanitary Sewer Extension to Lake Elmo, Authorize Extended Work Hours

Staff recommends Council adopt RESOLUTION NO. 07-198, a resolution authorizing extended work hours to MCES / Park Construction for the MCES Trunk Sanitary Sewer Extension to Lake Elmo.

D.     Appointment of Public Property Enforcement Officer

Staff recommends Council adopt RESOLUTION NO. 07-199, a resolution appointing James Westerman to the non-exempt part-time position of Public Property Enforcement Officer, effective October 1, 2007.

E.     Appointment of Part-time Secretary- Parks and Recreation

Staff recommends Council adopt RESOLUTION NO. 07-200, a resolution appointing Louise Sparkman to the non-exempt position of Part-time Secretary - Parks and Recreation, effective October 15, 2007.

F.     PERA Omitted Deduction Billing Approval

Staff recommends Council approval of the PERA Omitted Deduction Billing for $2,064.36 which equals $949.58 (Employer Deduction), $652.43 (Employee Deduction), and $241.22 (Interest).

G.     Reschedule November 21, 2007 Council Workshop to November 7, 2007

Staff recommends Council adopt a motion:

  1. To reschedule the Wednesday, November 21, 2007 Council Workshop to Wednesday, November 7, 2007. The workshop will begin at 6:30 p.m. and will be held in the City Council Chambers.

H.     Abstract of Bills

The abstract of bills includes payments made from the adopted 2007 budget for expenses of operating the city. The expenditures are from all funds of the city. Staff recommends approval of the abstract of bills. Any purchased contracts requiring signature of the Mayor and City Administrator is hereby approved.

 

7. Public Hearings (7:50 p.m.)

  1. Bertrand Lot Split Variances, Case No. 07-40
  2. Staff recommends Council adopt RESOLUTION NO. 07-203, a resolution denying a variance request for minimum lot frontage for 7340 Glen Road.

  3. Woodduck Drive Extension Utility and Street Improvements
  4. Staff recommends Council adopt RESOLUTION NO. 07-201, a resolution for assessment of Woodduck Drive Extension utility and street improvements.

  5. ERJ Dining IV, LLC, dba Chili's Grill and Bar, On Sale Intoxicating Liquor License Including Sunday Sales
  6. Staff recommends Council approve an on-sale intoxicating liquor license including Sunday sales to ERJ Dining IV, LLC dba Chili's Grill & Bar located at 9945 Hudson Place, Woodbury.

 

8. Discussion (8:15 p.m.)

  1. Local Board of Appeals and Equalization and Open Book Meeting Comparison
  2. Staff recommends Council adopt RESOLUTION NO. 07-202, a resolution transferring Local Board of Appeal and Equalization Duties to Washington County.
