5. Open Forum (7:40 p.m.)

The Open Forum is a portion of the Council meeting where a maximum of three persons will be allowed to address the Council on subjects which are not a part of the meeting agenda. Speakers are asked to limit their remarks to two minutes each. Persons wishing to speak must complete a sign-up sheet prior to the start of the meeting. Give the sign-up sheet to any staff person. The Council may take action or reply at the time of the statement or may give direction to staff at the end of the meeting regarding investigation of the concerns expressed.

6. Consent Agenda (7:45 p.m.)

All items listed under the consent agenda are considered to be routine by the City Council and will be enacted by one motion and an affirmative vote by roll call of a majority of the members present. There will be no separate discussion of these items unless a Council Member or citizen so requests, in which event, the items will be removed from the consent agenda and considered a separate subject of discussion by the Council.

A.     Authorize the Hiring of a Consulting Engineering Company and the Preparation of Plans and Specifications for the 2005 Park Pavement Program

Staff recommends Council approve a contract with CEI Engineering Associates, Inc. to provide engineering services and authorize the preparation of plans and specifications.

B.     Turnberry 4th Addition, Final Plat, Case No. 05-02

Staff recommends Council approval of the Final Plat of Turnberry 4th Addition subject to conditions.

C.     Pond Fencing Policy

Staff recommends Council adopt RESOLUTION NO. 05-22, a resolution to set a policy against placing fences around storm water holding ponds and wetlands.

D.     Radio Drive Improvements for Woodbury Lakes, S.A.P. 192-117-006 and S.A.P. 82-613-23 and Weir Drive from Valley Creek Road to Tamarack Road, Water, Sewer and Street Improvements, S.A.P. 192-101-09 and S.A.P. 82-616-17, Approve Cooperative Agreements with Washington County for the Purchase of Three Traffic Signal Cabinets and Controllers

Staff recommends Council adopt RESOLUTION NO. 05-23, a resolution approving the Cooperative Agreements with Washington County and authorizing the Mayor and City Administrator to sign said agreements for the purchase of three traffic signal cabinets and controllers. Two are for the Radio Drive Improvements for Woodbury Lakes and the third is for the Weir Drive from Valley Creek Road to Tamarack Road Improvements.

E.     Bailey Lake Storm Water Lift Station Expansion, Approval of Change Order No. 1

Staff recommends Council approve Change Order No. 1 for the Bailey Lake Storm Water Lift Station Expansion for Magney Construction in the amount of $12,165.43.

F.     Stop Sign Installation, Newbury Road at Lydia Lane

Staff recommends Council adopt RESOLUTION NO. 05-24, a resolution authoring the installation of two-way stop signs on Newbury Road at Lydia Lane.

G.     Settlers Ridge Parkway, Utility and Street Improvements, ¼ mile north and ¼ mile south of Valley Creek Road, S.A.P. 192-127-01, Order Project

Staff recommends Council adopt RESOLUTION NO. 05-25, a resolution ordering the project for Settlers Ridge Parkway utility and street improvements ¼ mile north and ¼ mile south of Valley Creek Road.

H.     Approval of Gift Resolution for Blankets from the MN Sheriff's Association

Staff recommends Council adopt RESOLUTION NO. 05-26, a resolution accepting the gift of 50 blankets from the Minnesota Sheriff's Association to the City of Woobury.

I.     Recommendation to Hire Gregory H. Schlichting as a Contract Employee in Public Safety

Staff recommends Council authorize the Mayor and City Administrator to enter into an employment agreement contract with Gregory H. Schlichting for the purposes of completing administrative projects in the Public Safety Department. Per the contract, Mr. Schlichting will be paid $30 per hour and be under the direction of the Public Safety Director.

J.     Children's Hospital Association Woodbury Guild, Temporary On Sale Intoxicating Liquor License

Staff recommends Council approve issuing a temporary on sale liquor license to Children's Hospital Association Woodbury Guild effective Thursday, February 10 from 7:00 p.m. to 10:00 p.m. for their fundraising event to be held at Eagle Valley Golf Course, which is located at 2600 Double Eagle Lane with the condition that those responsible for service of alcohol must first attend a brief training session conducted by the City's compliance officer.

K.     Appointment of Part-time Meter Reader

Staff recommends Council adopt RESOLUTION NO. 05-27, a resolution appointing Samuel Ly to the non-exempt position of Part-time Meter Reader, effective January 31, 2005.

L.     Substituting of Public Works Secretary Position in lieu of Public Works Technician Position

Staff recommends Council approval to not fill the current Public Works Technician vacancy and instead hiring a Public Works Secretary.

M.     Community Survey Proposal

Staff recommends Council approval of the proposal for Decision Resources to conduct the 2005 community survey at the invoiced cost.

N.     Abstract of Bills

The abstract of bills includes payments made from the adopted 2005 budget for expenses of operating the city. The expenditures are from all funds of the city. Staff recommends approval of the abstract of bills. Any purchase contracts requiring signature of the Mayor and City Administrator are hereby approved.

 

7. Public Hearings (7:50 p.m.)

  1. I-494/Valley Creek Road Interchange, S.A.P. 192-020-12, Grant Municipal Consent to MnDOT, Concur Construction Phasing
  2. Staff recommends Council adopt RESOLUTION NO. 05-28, a resolution granting consent to the Minnesota Department of Transportation for the I-494/Valley Creek Road Interchange within the City of Woodbury, S.A.P. 192-020-12 and RESOLUTION NO. 05-29, a resolution concurring with Washington County to Close the Valley Creek Road Bridge and I-494/Valley Creek Road Interchange during its Reconstruction, S.A.P. 192-020-12.

  3. Chipotle Mexican Grill of Colorado, LLC dba Chipotle Mexican Grill, On Sale Wine and Beer License Application
  4. Staff recommends Council approve issuing an on sale wine and beer liquor license to Chipotle Mexican Grill of Colorado, LLC dba Chipotle Mexican Grill.

  5. Items Associated with Lake Wilmes Third Addition
    1. Public Hearing: Lake Wilmes 3rd Addition, Preliminary Plat, Variance and Final Plat, Case No. 04-85, 04-86, 05-03
    2. Staff recommends Council approval of the Lake Wilmes 3rd Addition, Preliminary Plat, Variance and Final Plat, Case Nos. 04-85, 04-86 and 05-03 subject to conditions.

    3. Public Hearing: Lake Wilmes 2nd Addition Drainage and Utility Easement Vacation
    4. Staff recommends Council adopt RESOLUTION NO. 05-30, a resolution ordering the vacation of all previously recorded drainage and utility easements within the perimeter of Lots 1, 2 and 3, Block 1, Lake Wilmes 2nd Addition. The easement vacation will be conditional to recording of the Lake Wilmes 3rd Addition final plat.

    5. Action Item: City of Woodbury v. Walker Properties of Woodbury, LLC, et al. - Approval of Stipulation and Order Agreement
    6. Staff recommends Council approval of the Approval of Stipulation and Order Agreement for the City of Woodbury v. Walker Properties of Woodbury, LLC. et al. All conditions outlined in the Stipulation and Order Agreement between the City of Woodbury and Walker Properties of Woodbury, LLC shall be adhered to.
